ACCC applies for leave to appeal Pacific National Acacia Ridge acquisition

Australian Competition and Consumer Commission (ACCC) announced (26-Jun-2020) it applied for special leave from the High Court to appeal the Federal Court's decision on the acquisition of Aurizon's Acacia Ridge Terminal by Pacific National. As previously reported by the Centre for Rail, the Court found there was insufficient evidence that the acquisition was likely to result in substantial lessening of competition. Critically, the Court ruled that there is "no realistic prospect of new entry" to the market in the five to ten year timeframe. ACCC's initial appeal of the decision was dismissed on 06-May-2020.
